MINUTES OF BOARD OF COMMISSIONERS
WORK SESSION AND REGULAR MEETING
November 12, 2008
The Work Session of the Board of Commissioners of the Borough of West Cape May was called to order by Mayor Kaithern at 7:00 PM. The Open Public Meetings Statement was read by Mayor Kaithern who then led those present in the flag salute. Mayor Pamela Kaithern, Commissioner Dick Rigby, and Commissioner Peter Burke answered roll call. Also in attendance: Borough Clerk Elaine Wallace, Deputy Clerk Kate Kilian, Borough Solicitor Frank Corrado, and Borough Engineer Ray Roberts.

ENGINEER’S REPORT: None
OLD BUSINESS
Liquor Licenses: The questions on the ballot passed by over 60% of the vote. Now the Board needs to draft ordinances to establish the terms of the licenses and to amend the zoning ordinances in relation to the liquor licenses. Solicitor Corrado will draft both ordinances by the end of the month, based on allowing the licenses in all three commercial zones.
Alternative Energy – Wind Turbines: Commissioner Rigby was advised by the DEP they are only seeking to prohibit larger wind turbines south of Stone Harbor. The Board decided to use elements from both the BPU ordinance and the Lower Township ordinance. Engineer Roberts will work on incorporating the ordinances into one draft for further review.
Volunteer Fire Ordinance and Memo of Understanding: Nothing new at this time.
Planning/Zoning Board FAR Recommendation: The Board reviewed the draft prepared by Frank Corrado. Revisions will be made to make it clear what the bonus will be for FAR and Commissioner Rigby will work on a revised list of LEED standards that can be attached to the ordinance. Mr. Corrado will also add language to restrict the standards to only those on the list, with no option for a homeowner to request a waiver.
NEW BUSINESS
BPU’s Local Government Energy Audit Program: Commissioner Rigby will visit the booth at the League of Municipalities to get more information on the program.
November 26, 2008 meeting change/cancellation: The meeting must be held to allow for payment of bills, but will be limited in scope.
Consider Regulations for Solicitation: After some discussion, the Board agreed that formal regulations were unnecessary at this time. The Borough will continue the policy of having anyone requesting permission to solicit go to the Police Department to register their business and people who will be going door to door.
Possible Sale of Borough Property: The Revenue Committee, appointed by the Mayor, suggested selling Borough property that is not needed for public use. There is one lot on Willow Avenue, near Central, that could possibly be sold. Commissioner Rigby would like to look at the property in question before making a final decision. Solicitor Corrado explained that the Board would have to make a determination that the property is not needed for public purpose, then the lot could be sold at auction.
Authorize Bid for Refuse Truck: Clerk Elaine Wallace asked that a resolution be added to the consent agenda to authorize a notice to bidders for the refuse truck being funded through the County Joint Venture grant.
REVIEW OF REGULAR MEETING: Mayor Kaithern reviewed the Consent Agenda and Non-Consent agenda items.
The Work Session portion of the meeting was adjourned at 8:06 PM.
The Regular Meeting convened at 8:07 PM.

COMMISSIONERS REPORTS:
Mayor Kaithern announced that voter turnout was a record 81.8% at the November 4 election. Also, the local questions passed resoundingly – the two about allowing liquor licenses received over 60% approval, and the question about dedicating the funds generated to property tax relief passed with over 75%.
PUBLIC PORTION: No comments from the public.
The Regular Meeting was recessed into closed session at 8:10 PM. On motion of Commissioner Burke, seconded by Commissioner Rigby, the Regular Meeting was resumed at 8:38 PM.
There being no further business, a motion was made by Commissioner Rigby, seconded by Commissioner Burke, and carried unanimously by the Board of Commissioners to adjourn the meeting at 8:38 PM.
