MINUTES OF BOARD OF COMMISSIONERS
WORK SESSION AND REGULAR MEETING
December 16, 2009
The Work Session of the Board of Commissioners of the Borough of West Cape May was called to order by Mayor Kaithern at 1:08 PM. The Open Public Meetings Statement was read by Mayor Kaithern who then led those present in the flag salute. Mayor Pamela Kaithern, Deputy Mayor Peter Burke, and Commissioner Ramsey Geyer answered roll call. Also in attendance: Deputy Clerk Kate Kilian, Borough Solicitor Christine Cote’ and Engineer Ray Roberts, via phone.

WORK SESSION
ENGINEER’S REPORT: Ray Roberts reviewed the December Report. Mr. Roberts also noted that DPW Manager, Rob Flynn, requested to reverse the flow of traffic on Goldenbeaten Alley. Discussion ensued and the Commissioners agreed to do so by Ordinance that will be introduced in January 2010.
OLD BUSINESS
Solar Energy: Commissioner Geyer stated there is nothing new to report.
Sunset Boulevard Parking Lot: Commissioner Geyer stated there is nothing new to report.
NEW BUSINESS Deputy Commission Burke requested a Resolution be added to the January 6, 2010 agenda to thank Rutgers University for the Sustainable study. The study was presented to the Public on 12/10/09 and was well received.
REVIEW OF REGULAR MEETING: Mayor Kaithern reviewed the Consent Agenda and Non-Consent agenda items.
The Work Session portion of the meeting was adjourned at 1:23 PM and the Regular Meeting convened at 1:25 PM.
CONSENT AGENDA: On motion of Commissioner Geyer, seconded by Deputy Mayor Burke, the following Consent Agenda was unanimously approved on roll call vote.

NON-CONSENT AGENDA:
COMMISSIONER REPORTS
Commissioner Geyer wished everyone a safe and happy holiday. Commissioner Geyer inquired as to when the one way sign will be placed at Goldenbeaten Alley. Mayor Kaithern stated the sign is on order.
Deputy Mayor Burke cautioned everyone to be safe during the holidays and enjoy the festivities. Deputy Mayor Burke announced that there would be a blood drive in February 2010 and details will be forthcoming.
Mayor Kaithern stated that the accessory apartment handout is available in the Clerks office and will be a helpful tool for those interested. Mayor Kaithern wished her fellow Commissioners, the staff and residents a safe and happy holiday season.
PUBLIC PORTION:
Mike Bean, 400 Fow Avenue, inquired if the accessory apartment information will be available online. Mayor Kaithern said yes. Mr. Bean inquired about the 15 year deed restriction on the accessory apartments and do other municipalities have this restriction? Mayor Kaithern said yes other municipalities have the restriction and that the restriction was placed by Judge Nugent. The Plaintiff requested a 20 year restriction and the Borough asked for a 10 year restriction. Mayor Kaithern briefly explained the accessory apartment program. Mr. Bean wanted to know if the homeowners are responsible for the maintenance on the accessory apartment. Mayor Kaithern said yes, the homeowners are responsible.
Mr. Bean inquired if there has been any further discussion on the water rates. Mayor Kaithern stated she received the questions from Kathy Gallagher at the 12/9/09 7PM meeting and the questions were directed to the staff on the morning of Thursday, 12/10.
When no one else wished to speak, the public portion was closed and Deputy Mayor Burke made a motion, seconded by Commissioner Geyer, to adjourn the meeting at 1:40 PM.
