MINUTES OF BOARD OF COMMISSIONERS
WORK SESSION AND REGULAR MEETING
April 28, 2010

The Work Session of the Board of Commissioners of the Borough of West Cape May was called to order by Mayor Kaithern at 1:05 PM.  The Open Public Meetings Statement was read by Mayor Kaithern who then led those present in the flag salute.  Mayor Pamela Kaithern and Deputy Mayor Peter Burke answered roll call; Commissioner Geyer was absent.  Also in attendance:  Borough Clerk Elaine Wallace and Borough Solicitor Frank Corrado (arrived 1:15).

WORK SESSION
OLD BUSINESS
Solar Energy/Energy Audit:  The Borough received 3 proposals for the energy audit.  The Commissioners and two members of the Planning Board will review the proposals and rate them.  The one that receives the most points will be chosen to perform the audit.

Sunset Boulevard Parking Lot:  There was nothing new to report.

NEW BUSINESS
Special Events Ordinance:  The Borough Solicitor will review the ordinance in order to make some clarifications.  He felt that every event needs to be approved by the Borough and provide proof of insurance, regardless of the circumstances of the event. 

Amnesty for People Illegally Connected to Water System or Discharging a Sump Pump into the Sanitary Sewer System:  Mayor Kaithern explained that the consultant hired to investigate the water system losses found problems with not just water but sewer flows as well.  He suggested offering an amnesty period to allow people that may be illegally hooked up to the water system to become legal without fines or penalties.  He also suggested the same for people who illegally drain sump pumps into the sanitary sewer system.  Solicitor Corrado felt the sump pump issue should be handled by educating the public since the Borough can’t determine who is doing it without going into private property.  Mr. Corrado will prepare an ordinance to allow an amnesty period and to increase the general fine provisions of the code. 

REVIEW OF REGULAR MEETING:  Mayor Kaithern reviewed the Consent Agenda and Non-Consent agenda items.

The Work Session portion of the meeting was adjourned at 1:56 PM and the Regular Meeting convened at 2:00 PM.

CONSENT AGENDA:  On motion of Deputy Mayor Burke , seconded by Mayor Kaithern, the following Consent Agenda was unanimously approved on roll call vote.

Ordinances for Introduction and Publication: None

Resolutions:

    1. Authorizing Special Event Permit to Wendy Guiles for Use of Backyard Park
    2. Bill Payment
    3. Authorizing a Professional Services Contract with Triad Associates for NJDCA Small Cities Grant Implementation

 

NON-CONSENT AGENDA:
ORDINANCES FOR SECOND READING AND ADOPTION:

    1. Exceed the Municipal Budget Appropriation Limits and to Establish a Cap Bank

Deputy Mayor Burke made a motion, seconded by Mayor Kaithern, to open the public hearing on the above ordinance.  When no one from the public wished to speak, Deputy Mayor Burke made a motion to close the public hearing and adopt Ordinance 444-10.  Mayor Kaithern seconded the motion which was carried unanimously on roll call vote.

    1. Bond Ordinance Appropriating $110,000 and Authorizing the Issuance of $104,500 in Bonds and Notes of the Borough of West Cape May for Various Improvements (Supplemental Debt Statement - .30% - acknowledged by DLGS on March 31, 2010)

 

Deputy Mayor Burke made a motion, seconded by Mayor Kaithern, to open the public hearing on the above ordinance.  When no one from the public wished to speak, Deputy Mayor Burke made a motion to close the public hearing and adopt Ordinance 445-10.  Mayor Kaithern seconded the motion which was carried unanimously on roll call vote.

    1. Bond Ordinance Appropriating $220,000 and Authorizing the Issuance of $209,000 in Bonds and Notes of the Borough of West Cape May for Improvements to the Water and Sewer Utility Infrastructure (Supplemental Debt Statement - .30% - acknowledged by DLGS on March 31, 2010)

 

Deputy Mayor Burke made a motion, seconded by Mayor Kaithern, to open the public hearing on the above ordinance.  When no one from the public wished to speak, Deputy Mayor Burke made a motion to close the public hearing and adopt Ordinance 446-10.  Mayor Kaithern seconded the motion which was carried unanimously on roll call vote.

COMMISSIONERS REPORTS:
Deputy Mayor Burke commented on a report in the Herald that fire grants are available through a program under Homeland Security.  Application deadline is May 8th.  He also commented on how fortunate West Cape May is to have so many volunteers.  Eight volunteers helped the Environmental Commission with the annual clean up of Sunset Boulevard including Louise Zemaitis, Bob Fogg, Hilary Pritchard, Miggy Lynn, Paul & Michelle Mulligan, Pam Kaithern and Peter Burke.  Five volunteers helped with the Shade Tree Commission clean up of Wilbraham Park including Todd Land, Ron Baker, Shelly Rhoads, Pam Kaithern, and Peter Burke.

Mayor Kaithern announced that Amaleta Moore had passed away and her services will be held at Macedonia Baptist Church on Saturday morning.  Amaleta was a great educator and asset to the community and will be greatly missed.  Mrs. Kaithern also announced that the Center for Community Arts is hosting a photo exhibit in the back of the auditorium entitled “Black, Blue and True” and invited everyone to take a look.  Lastly, she reported the consultant is still working on the water loss report.  As part of the research, he suggested the Borough institute an amnesty period to get more people into compliance.

There being no further business, a motion was made by Deputy Mayor Burke, seconded by Mayor Kaithern, and carried unanimously by the Board of Commissioners to adjourn the meeting at 2:14 PM.
