MINUTES OF BOARD OF COMMISSIONERS
WORK SESSION AND REGULAR MEETING
December 19, 2007

The Work Session of the Board of Commissioners of the Borough of West Cape May was called to order by Mayor Kaithern at 12:00 PM.  The Open Public Meetings Statement was read by Mayor Kaithern who then led those present in the flag salute.  Mayor Pamela Kaithern, Commissioner Dick Rigby, and Commissioner Peter Burke answered roll call.  Also in attendance:  Borough Clerk Elaine Wallace, Deputy Clerk Kate Kilian, Clerk Secretary Terry Franklin, Borough Solicitor Jennifer Russo-Belles, and Borough Engineer Ray Roberts.

WORK SESSION
OLD BUSINESS
Engineer’s Report:  Ray Roberts reviewed his report for December 2007.

Liquor Licenses:  Commissioner Rigby is working with Terry Franklin to obtain ordinances from other municipalities.  They will then create a matrix showing regulations on hours, number of seats, etc. for further discussion.

Court Consolidation:  Nothing new at this time.

Solar Panels:  Commissioner Rigby announced he signed an application for a rebate with the BPU to get in line for funding.

Park Boulevard Bike Lanes:  Nothing new at this time that wasn’t covered in the Engineer’s Report.  This topic will be removed from Old Business and covered during the monthly engineer’s report in the future.

Burton Property Request:  Nothing new at this time.

County Health Inspection of Bed and Breakfast:  Commissioner Burke found the business owners not opposed to having the inspections by the County Health Department.  The Commissioners will consider an ordinance at the next meeting to ask the County to reinstitute these inspections.

Use of Wilbraham Park:  Kate Kilian advised the Commissioners the organizations she contacted would like more time to consider moving events to the Backyard Park.  They won’t be able to give an answer until sometime in January.

NEW BUSINESS – None

REVIEW OF REGULAR MEETING:  Mayor Kaithern reviewed the Consent Agenda and Non-Consent agenda items.

Resolution 187-07:  After some discussion, wording was changed in Section 3 of the resolution as follows:  “All items listed in a through q may be taken to the Cape May County Municipal Utilities Authority by or on behalf of the individual generator for lawful disposal in accordance with this resolution and Ordinance 400-07 resident, business owner, business operator and/or property owner.

Ordinance 407-07:  Commissioner Burke asked that the Board consider postponing the ordinance to allow the Fire Company’s attorney time to review it.  There were several representatives of the Fire Company present and some discussion ensued about budgeting, building maintenance, and Company hierarchy, among other topics.  Chief McPherson advised the Mayor he will be submitting a detailed budget request which will include expenses for several State requirements the Company needs to meet.  The Company will also provide the Borough with a membership list, delegation of responsibilities and related contact information, and information on LOSAP.  Commissioner Rigby agreed to speak with the Public Works Manager about what could be done with the Borough’s sign which causes some obstruction to the men when driving the fire truck.  Lastly, Mr. McPerson advised the Borough that Tony Bierberi will be the new President of the Fire Company.

The Work Session portion of the meeting was adjourned at 1:17 PM.

The Regular Meeting convened at 1:24 PM.

CONSENT AGENDA:  On motion of Commissioner Burke, seconded by Commissioner Rigby, the following Consent Agenda was unanimously approved on roll call vote.

NON-CONSENT AGENDA:
Ordinances for Second Reading and Public Hearing
405-07  Amending and Supplementing Chapter 27 Zoning of the Revised General Ordinances of the Borough of West Cape May

Commissioner Burke made a motion, seconded by Commissioner Rigby and carried unanimously on roll call vote, to open the public hearing on the above ordinance.  When no one from the public wished to speak, Commissioner Burke made a motion to close the public hearing and adopt Ordinance 405-07.  Commissioner Rigby seconded the motion which was carried unanimously on roll call vote.

    1. A Bond Ordinance Appropriating $36,000 and Authorizing the Issuance of $34,200 in Bonds and Notes of the Borough of West Cape May for the Various Improvements or Purposes Authorized to be Undertaken by the Borough of West Cape May, New Jersey

Supplemental Debt Statement acknowledged by the State December 10, 2007

Commissioner Burke made a motion, seconded by Commissioner Rigby and carried unanimously on roll call vote, to open the public hearing on the above ordinance.  When no one from the public wished to speak, Commissioner Burke made a motion to close the public hearing and adopt Ordinance 406-07.  Commissioner Rigby seconded the motion which was carried unanimously on roll call vote.

    1. Establishing the West Cape May Volunteer Fire Company as the Official Fire Company for the Borough of West Cape May

 

Commissioner Burke made a motion to postpone second reading and adoption to the January 23, 2008 meeting at 1:00 PM.  Mayor Kaithern seconded the motion which was carried unanimously on roll call vote.

Commissioners Reports:
Commissioner Rigby announced that while DOT did not have money for funding at this time, he and Gary Novak will be meeting with DCA to discuss possible grant opportunities to perform streetscape work suggested in the Rhodeside and Harwell report on the intersection of Broadway and Sunset.

Commissioner Burke and Mayor Kaithern had nothing to report at this time.

 

Public Portion: No one from the public wished to speak.

On motion of Commissioner Rigby, seconded by Commissioner Burke, and carried unanimously on roll call vote, the meeting was adjourned at 1:34 PM.
