MINUTES OF BOARD OF COMMISSIONERS
WORK SESSION AND REGULAR MEETING
June 25, 2008

The Work Session of the Board of Commissioners of the Borough of West Cape May was called to order by Mayor Kaithern at 1:10 PM.  The Open Public Meetings Statement was read by Mayor Kaithern who then led those present in the flag salute.  Mayor Pamela Kaithern, Commissioner Dick Rigby, and Commissioner Peter Burke answered roll call.  Also in attendance:  Borough Clerk Elaine Wallace, Deputy Clerk Kate Kilian, Borough Solicitor Christine Cote’, and Borough Engineer Ray Roberts.

WORK SESSION
ENGINEER’S REPORT:  Ray Robert reviewed the monthly engineer’s report.

OLD BUSINESS
Liquor Licenses:  Nothing new at this time.

Alternative Energy:  The materials have been delivered and work, which was supposed to be done last week, is expected to start next week.  Concern was expressed over work being started during the Farmers Market.

Volunteer Fire Ordinance and Memo of Understanding:  Solicitor Cote’ will attend a meeting with the Volunteer Fire Company and its attorney Mr. Braslow next week to present and discuss the draft documents.  Ms. Cote’ will verify if there are state regulations governing parking for fire companies.  Ms. Cote’ will also provide them with several JIF documents and reports with which they must comply.

JIF Facility Use Application:  Nothing new at this time.

WCM History Committee – Waiver of Application Fee Wilbraham Park:  The Shade Tree Commission will meet on July 8th to discuss and then advise the Board of its recommendation.

Authorize Online Publication of Municipal Legal Notices:  Commissioner Burke provided copies of the law that would permit governmental agencies to publish all notices on the internet instead of in the newspaper.  The Board will pass a resolution of support at the next meeting.

Triad Administrative Proposal for COAH:  Triad is reviewing the Borough’s COAH plans to determine the extent of the work they could perform at this time and the cost thereof.

Widening of Elmira:  Commissioner Rigby advised the Board that at this time Cape May plans to widen only the portion of Elmira Street between Lafayette Street and Broad Street.

NEW BUSINESS
Moratorium on Street Openings during Summer Months:  Public Works Manager Rob Flynn requested the Board restrict street openings during the summer.  The Board reviewed the draft ordinance scheduled to be introduce during the regular meeting.

Sidewalk Repair at 316 North Broadway:  The homeowner had advised the Borough that the sidewalk was uplifted due to tree roots.  The Borough’s ordinance requires the Board to adopt an ordinance advising the homeowner of the repairs that need to be made.  After some discussion, the Board amended the resolution scheduled on the consent agenda.

REVIEW OF REGULAR MEETING:  Mayor Kaithern reviewed the Consent Agenda and Non-Consent agenda items. 

Resolution #90-08 Providing for a Closed Session Not Open to the Public in Accordance with the Provisions of the New Jersey Open Public Meetings Act NJSA 10:4-12

On motion of Commissioner Rigby, seconded by Commissioner Burke, the above referenced resolution was passed on unanimous roll call vote.

The Work Session was recessed into Closed Session at 2:46 PM and reconvened into 2:53 PM.

The Work Session portion of the meeting was adjourned at 2:54 PM and the Regular Meeting convened at 2:56 PM.

CONSENT AGENDA:  On motion of Commissioner Burke, seconded by Commissioner Rigby, the following Consent Agenda was unanimously approved on roll call vote.

413-08 Bond Ordinance Appropriating $120,000 and Authorizing the Issuance of $66,500 in Bonds and Notes of the Borough of West Cape May for the Various Improvements or Purposes Authorized to be Undertaken by the Borough of West Cape May (Supplemental Debt Statement - .18%)

NON-CONSENT AGENDA:
ORDINANCES FOR SECOND READING AND PUBLIC HEARING:  None

COMMISSIONERS REPORTS:

Commissioner Burke reminded everyone that the Farmers Market begins Tuesday, July 1st.  The Band performing opening day will be Blue Bones.  Mr. Burke will be meeting with the Red Cross representative to discuss the next blood drive tentatively scheduled for Tuesday August 26th.  Some concern was raised over having the blood drive on the same day as the Farmers Market.

PUBLIC PORTION:  No one from the public wished to speak

The Regular Meeting was recessed into Closed Session 3:03 PM.  On motion of Commissioner Burke, seconded by Commissioner Rigby, the Regular Meeting was reconvened at 3:43 PM.  There were no actions taken as a result of the Closed Session.

 

On motion of Commissioner Rigby, seconded by Commissioner Burke, the Regular Meeting was adjourned at 3:45 PM.
