MINUTES OF BOARD OF COMMISSIONERS
WORK SESSION AND REGULAR MEETING
May 14, 2008

The Work Session of the Board of Commissioners of the Borough of West Cape May was called to order by Mayor Kaithern at 7:00 PM. The Open Public Meetings Statement was read by Mayor Kaithern who then led those present in the flag salute. Mayor Pamela Kaithern, Commissioner Dick Rigby, and Commissioner Peter Burke answered roll call. Also in attendance: Borough Clerk Elaine Wallace, Deputy Clerk Kate Kilian, Borough Solicitor Frank Corrado, Borough Solicitor Christine Cote’, Borough Engineer Ray Roberts (left at 7:13 PM), and Planning Board Chairperson Gary Novak.

CERTIFICATE OF RECOGNITION
Mayor Kaithern presented a certificate of recognition to Lorena Friday who celebrated her 100th birthday on May 8, 2008.

Resolution 77-08 Scheduling of a Closed Session Pursuant to NJSA 10:4-12 (Sixth Street Partners Litigation and Negotiations)

On motion of Commissioner Rigby, seconded by Commissioner Burke, the above resolution was passed unanimously on roll call vote.

The Work Session was recessed into closed session at 7:13 PM. At 9:09 PM, on motion of Commissioner Rigby, seconded by Commissioner Burke, and carried unanimously on roll call vote, the Work Session was reconvened.

WORK SESSION
ENGINEER’S REPORT: None

OLD BUSINESS
Liquor Licenses: Commissioner Rigby will have a report at the next meeting.

Court Consolidation: Discussion will be rescheduled for July.

Alternative Energy: Commissioner Rigby provided a letter to the Cape May Construction Office stating Borough Hall was not in the Historic District, so a building permit could be issued. He expects the work to begin in approximately 2 weeks.

Volunteer Fire Ordinance and Memo of Understanding: In deference to the time, this discussion will be held until the next meeting.

Use of Wilbraham Park for 2009 Season: The Board will reschedule discussion on this for September to determine the success of the event being held in the Backyard Park.

JIF Facility Use Application: Christine Cote’ drafted an ordinance to incorporate JIF requirements and govern special events being held on any Borough property. The ordinance would set up the process to apply for the use and enter into the agreement for use.

NEW BUSINESS
NJ League of Municipalities – Pledge to fight COAH Round 3 Regulations: The NJ League of Municipalities asked for a commitment from municipalities to fight the 3rd round COAH regulations. The Board was in favor of this.

Amendment to Agreement with Cape May for Radio Water Meters: Mayor Kaithern explained that the process should be moving forward. USDA required the percentage of the installation cost that the Borough would have to pay. Cape May provided a figure of 17% which equals $6,502.50 with an annual maintenance fee of around $1,140.

REVIEW OF REGULAR MEETING: Mayor Kaithern reviewed the Consent Agenda and Non-Consent agenda items.

The Work Session portion of the meeting was adjourned at 9:34 PM.

The Regular Meeting convened at 9:38 PM.

CONSENT AGENDA: On motion of Commissioner Burke, seconded by Commissioner Rigby, the following Consent Agenda was unanimously approved on roll call vote.

COMMISSIONERS REPORTS:
Commissioner Rigby announced that Friday, May 16th is “Bicycle to Work Day.”

PUBLIC PORTION: No one wished to speak.

When no one else wished to speak the meeting was adjourned at 9:43 PM on motion of Commissioner Rigby, seconded by Commissioner Burke.
