WORK SESSION AND REGULAR MEETING
September 26, 2007
The Work Session of the Board of Commissioners of the Borough of West Cape May was called to order by Mayor Kaithern at 1:06 PM. The Open Public Meetings Statement was read by Mayor Kaithern who then led those present in the flag salute. Mayor Pamela Kaithern, Commissioner Dick Rigby, and Commissioner Peter Burke (arriving at 1:15 PM) answered roll call. Also in attendance: Borough Clerk Elaine Wallace, Deputy Clerk Kate Kilian, Borough Solicitor Jennifer Russo-Belles, and Borough Engineer Ray Roberts.
WORK SESSION
OLD BUSINESS
Engineer’s Report: Ray Roberts reviewed the monthly report dated September 26, 2007, including status on the Park Boulevard Bike project. Mr. Robert recommended putting the project out to bid in December and receiving bids in January with an estimated start date of mid-February. That timeline should get the project done by May 1st of next year. The Commissioners were worried about the work not getting done before next season, but agreed to follow the recommendations of the engineer.
Liquor Licenses: The Commissioners decided to have a Public Session on the Liquor License referendum on Monday, October 15th at 7:00 PM.
Court Consolidation: Commissioner Rigby announced there will be a kickoff meeting with Cape May and Cape May Point on October 3rd. Jersey Professional Management expects to finish the study in 4-6 weeks.
Solar Panels: The project was advertised and so far two bid packages have been picked up by contractors. The bids will be opened October 17th.
Park Boulevard Bike Lanes: Discussed during the engineer’s report
NEW BUSINESS
Fire Company: No discussion, the ordinance will be tabled at this time.
Cape Human Resources: The organization’s request to have a satellite office in Borough Hall was discussed. They would like to use the Caucus Room Monday through Wednesday from 10 AM to 1 PM in October, November and December. This would be a public service for people who have difficulty getting to the main office. A resolution is scheduled for action during the regular meeting.
REVIEW OF REGULAR MEETING: Mayor Kaithern reviewed the Consent Agenda and Non-Consent agenda items. Commissioner Rigby asked that Ordinance 400-07 be amended to include hard plastics as a category for recycling. There were also a few other clarifications made to that ordinance. Ordinance 401-07 was tabled awaiting further input from the Court Master. Ordinance 402-07 was tabled pending language revision. Mr. Rigby asked that Resolution 149-07 be amended to remove the addition of Stevens Street. Mayor Kaithern announced that she would not be able to vote on the Resolution because she lives on Stevens Street and asked the resolution be moved from the consent agenda for immediate action in light of Mr. Rigby having to leave early.
Resolution 149-07 Adopting the Recommendation of the Historic Preservation Commission to Adopt the Historic Preservation Survey Completed by West Cape May History Committee
On motion of Commissioner Rigby, seconded by Commissioner Burke, the above referenced resolution was approved on roll call vote as follows: Burke and Rigby answered in the affirmative, Kaithern abstained.
The Work Session portion of the meeting was adjourned at 1:57 PM.
The Regular Meeting convened at 2:00 PM.

Housing Program Pursuant to the Fair Housing Act
Commissioner Burke made a motion, seconded by Commissioner Rigby, to open the public hearing on the above ordinance. When no one from the public wished to speak on this ordinance, Commissioner Rigby made a motion to close the public hearing and adopt Ordinance 395-07. Commissioner Burke seconded the motion which was carried unanimously on roll call vote.
Resolutions
153-07 Resolution Appointing Municipal Housing Liaison
On motion of Commissioner Burke, seconded by Commissioner Rigby, the resolution was passed unanimously on roll call vote.
154-07 Authorize Use of Borough Hall by Cape Human Resources
On motion of Commissioner Burke, seconded by Commissioner Rigby, the resolution was passed unanimously on roll call vote.
Mayor Kaithern altered the order of the agenda to have the public portion at this time.
PUBLIC PORTION:
Jim Roney, 309 First Avenue, asked if Cape Human Resources would be in Borough Hall three days each month. Deputy Clerk Kilian explained they would be using the building three days a week, every week until the end of the year.
Olga Rabiolo, 425 Sunset Boulevard, expressed concern about having a circle at Wilbraham Park. Mayor Kaithern explained that it was only one suggestion that would be discussed on October 10th at 7:00 PM when Rhodeside and Harwell present their recommendations on reworking the core business district. Ms. Kaithern suggested Ms. Rabiolo attend that presentation. Mr. Rigby also suggested she attend the October 11th presentation by Gina Delaveccia’s bike and pedestrian presentation.
Commissioner Rigby left the meeting at 2:15 PM.
Michael Bean, 400 Fow Avenue, asked where the Borough was with changing lot coverage in R1 and R2 districts. The ordinance comes up for public hearing on October 10th. Mr. Bean is on a Taxpayers committee and wanted some clarification on what changes were being made and had a few questions about some examples that were given in error during a planning board meeting. Mayor Kaithern asked him to contact her during regular business hours because she did not have a copy of the ordinance in front of her and did not want to misquote figures or information. She also advised Mr. Bean that both the Planning Board and Governing Body have open public meetings twice per month that he was welcome to attend.
When no one else from the public wished to speak, the Mayor closed the Public Portion.
COMMISSIONERS REPORTS:
Commissioner Burke announced that 400 bulbs have been purchased by the Shade Tree Commission for planting in Wilbraham Park. He also announced that information is available on speed limits set by the County along Perry Street/Sunset Boulevard. The meeting of the Greater Cape May Historical Society will be held September 27th at the Fire Hall. The County is holding a flu shot clinic on October 10th. The Lima Bean festival will be held October 6th, with a rain date of October 7th.
Mayor Kaithern announced Alys Dolmitch, who was the founder of the Lima Bean festival and died earlier this year, would be honored at the festival. On behalf of Commissioner Rigby, she re-iterated the following dates: October 10th Rhodeside and Harwell presentation at 7:00 PM, October 11th. Bike and Pedestrian open house by Gina Delaveccia from 4:00 PM to 7:00 PM. She also announced the Borough sold bond anticipation notes, which accounts for almost $2 million on this weeks bill list. Lastly, Mrs. Kaithern read some of the other items of interest on the bill list, including payments to the schools, electric bills and fire engine repair bills.
There being no further business, a motion was made by Commissioner Burke, seconded by Mayor Kaithern, and carried unanimously on roll call vote to adjourn the meeting at 2:35 PM.
